Terms of Service
Effective date: October 5, 2026
These Terms of Service describe the conditions for using BrightHaus's website and requesting or purchasing our lighting services. "BrightHaus," "we," "us," and "our" refer to BrightHaus.
1. Scope and Acceptance
You may browse our website without purchasing services. Submitting an inquiry does not create a service contract or authorize installation.
When purchasing services, you agree to the estimate, service agreement, and these Terms expressly incorporated into your agreement. If these Terms conflict with a signed project agreement, the signed agreement controls, subject to applicable law.
2. Services
BrightHaus provides holiday, multi-holiday, and permanent lighting services. Depending on your agreement, services may include design, materials, installation, programming, maintenance, removal, and storage.
Only services identified in your accepted estimate or agreement are included. Additional decorations, programming visits, repairs, or installation and removal cycles require separate approval.
3. Estimates and Changes
Photo-based or aerial measurements are preliminary unless identified as verified. Final pricing may depend on measurements, roof pitch, access, mounting surfaces, electrical availability, equipment requirements, and the approved design.
We will disclose material scope or price changes and obtain your approval before performing additional work. An estimate is valid for the period stated on the estimate.
4. Payments
Your agreement or invoice identifies the required deposit, payment schedule, and due dates. Installation scheduling is subject to receipt of any agreed deposit and completion of required approvals.
Any applicable taxes, travel charges, equipment charges, storage fees, or permitted payment fees will be disclosed before you accept the agreement.
Credit-card payments are processed through Square or another identified payment provider. Any card fee will be disclosed before payment and applied only where permitted by applicable law and payment-network rules.
5. OMNI C9 Lighting Leases
Unless your signed agreement states otherwise, OMNI C9 multi-holiday lights, controllers, and related leased equipment remain BrightHaus's property.
Three-year lease agreements specify annual charges, payment schedules, included services, and any third-year discount. Discounts apply only to the scope and charges identified in the agreement.
Customers must not sell, transfer, remove, modify, or allow another contractor to alter leased equipment without BrightHaus's written approval.
Any early termination payment must be expressly stated in the signed lease. Where the lease provides for payment of the remaining scheduled balance, that payment does not transfer equipment ownership to the customer. BrightHaus retains ownership and will coordinate retrieval.
Early termination provisions remain subject to applicable law and do not override statutory cancellation rights or remedies for BrightHaus's failure to perform.
6. Permanent Lighting
Permanent lighting estimates identify the components, mounting method, installation scope, and included programming.
Ownership, manufacturer warranties, workmanship coverage, and any maintenance plan are governed by the signed agreement. An extended or lifetime warranty applies only when expressly provided in a separate written warranty or maintenance agreement.
Internet service, compatible devices, third-party applications, and electrical improvements are the customer's responsibility unless included in the estimate.
7. Property Access and Customer Responsibilities
You confirm that you own the property or have authority to approve the work. You are responsible for obtaining any required landlord, association, or other property approvals identified as your responsibility in the agreement.
Please provide safe access, suitable electrical power, and accurate information about known hazards or damaged mounting surfaces. Keep pets secured and work areas reasonably clear.
BrightHaus may pause work if conditions are unsafe and will discuss the next steps with you.
8. Scheduling and Weather
Installation and removal dates are subject to the agreed schedule, weather, access, equipment availability, and safe working conditions.
We will communicate significant delays and coordinate revised dates. Nothing in this section eliminates obligations or remedies provided by your agreement or applicable law.
9. Maintenance and Damage
Report lighting outages or installation concerns promptly to brighthausllc@gmail.com.
Included maintenance is defined in your agreement. Repairs involving customer alterations, landscaping equipment, animals, vandalism, or other causes outside the included coverage may require a separate charge, disclosed for approval before work.
BrightHaus remains responsible for damage caused by its negligence to the extent required by law. Please notify us promptly of any suspected damage so we can investigate.
10. Removal and Storage
Seasonal removal and storage are included only when stated in your agreement. Removal timing depends on the agreed service window and safe conditions.
Storage charges, including any per-tote pricing, will be identified in your estimate or agreement. Customers must coordinate access for retrieval of BrightHaus-owned equipment when a lease ends.
11. Cancellations and Refunds
Contact us in writing if you need to cancel or reschedule. Deposits, refunds, custom materials, completed work, and early lease termination are governed by the signed agreement and applicable law.
These Terms do not create a blanket nonrefundable-deposit policy or waive legally required cancellation rights.
12. Text and Email Communications
With appropriate consent, BrightHaus may send estimate follow-ups, appointment reminders, billing notices, and service updates. Promotional text messages require separate consent. Marketing consent is not a condition of purchase.
Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe from text messages or HELP for assistance. You may also email brighthausllc@gmail.com. Carriers are not liable for delayed or undelivered messages.
Submitting a website form does not, by itself, authorize promotional texts.
13. Privacy and Website Use
Our Privacy Policy explains how we handle personal information.
You agree not to misuse our website, submit fraudulent requests, attempt unauthorized access, or interfere with its operation. BrightHaus's website content and branding may not be reproduced commercially without permission.
Third-party websites, payment services, and lighting applications have their own terms and privacy policies.
14. Disputes and Applicable Law
Please contact us first about a service concern so we can attempt to resolve it.
These Terms are governed by Wisconsin law, subject to any mandatory protections that apply. Nothing in these Terms waives consumer rights or remedies that cannot lawfully be waived.
15. Changes to These Terms
We may update these Terms and post a revised effective date. Updates do not automatically change an existing signed agreement. Material changes to an existing project agreement require the parties' agreement unless otherwise permitted by law.
